California's states'-rights battle against the Bush administration over global warming was freed to move forward in federal court on February 29, after the Environmental Protection Agency issued its long-delayed for blocking the state's 2002 law curbing greenhouse emissions from cars and trucks. EPA Administrator Stephen Johnson signed a Federal Register notice on February 29 denying California's request for a waiver under the Clean Air Act, to control greenhouse gas emissions from motor vehicles. The waiver states, "This decision is based on the Administrator's finding that California does not need its greenhouse gas standards for new motor vehicles to meet compelling and extraordinary conditions."
